Perfecthost  Acceptable Use Policy and Service Guidelines

Perfecthost provides web hosting to many clients, and we have a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.

Content:

All services provided by Perfecthost may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene,  material protected by trade secret and other statute, and invasion of privacy. The subscriber agrees to indemnify and hold harmless Perfecthost from any claims resulting from the use of the service which damages the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all Perfecthost servers. This includes sites that may infer sexual content or links to adult content elsewhere. Perfecthost will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Perfecthost servers or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Warez sites

Perfecthost will be the sole arbiter as to what constitutes a violation of this provision.

Commercial Advertising - Email:

Spamming, or the sending of unsolicited email, from a Perfecthost server or using an email address or domain that is maintained on an Perfecthost machine as reference is STRICTLY prohibited.  Accounts found to be sending spam will be terminated immediately and no refund given.  Perfecthost will be the sole arbiter as to what constitutes a violation of this provision.

Misuse of System Resources:

Any attempt to undermine or cause harm to a server, or customer, of Perfecthost is strictly prohibited. This includes, but is not limited to: using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or auto-responders other than for the customer's own account; use of servers for backup of files unrelated to the web site of the account; or resale or remote access to CGI scripts installed on our servers. Operation of IRC servers, IRC bots,  or maintaining or creating any free for all (FFA) type sites on our servers will result in an immediate termination of service.

Cancellation:

Cancellation can be made via email to sales@perfecthost.net. Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service all hosting fees will be refunded. This does not include fees for domain registration which are non-refundable.

Suspension:

Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.

Responsibility Concerning Service and Backups:

Perfecthost strives to provide reliable hosting services for all our clients and provides backup services as a courtesy.  However, server disorders, network latency, connectivity issues, etc. arise with any webhosting services.  Clients are encouraged to make backups of their website and all online data .  Perfecthost is not to be held responsible, under any circumstances, for loss of data or website accessibility failure.  Again, hosting clients are encouraged to make backups of their data.

Refunds:

All accounts come with a 30 day money-back guarantee.  If, for any reason during the first 30 days of service, you are dis-satisfied with the service provided by Perfecthost, your money will be promptly returned.

Accounts terminated for violation of the Acceptable Use Policy (AUP) will not receive a refund. 

Refusal of Service:

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

All sub-networks, distributive hosting sites, and dedicated servers of Perfecthost must adhere to the above policies. Please direct any reports of violations of the above policies to abuse@perfecthost.net.

Failure to follow any term or condition will be grounds for immediate account deactivation.

Perfecthost Privacy Policy
 

Perfecthost is firmly committed to the privacy of our clients. We have developed the following policy to disclose the information gathering and dissemination practices for this site.

We collect certain information from clients for billing and administrative functions. None of the information collected for these functions is provided to any outside party for any reason.
 

From time to time we receive inquiries for examples of sites hosted by our service. If you would like to have your site available for such use, please contact sales@perfecthost.net. No information other than your sitename will be provided to the individual making the inquiry. Personal information that may be displayed on the client site is the responsibility of the client.

Security measures are in place to protect against loss, alteration, or misuse of data collected. Clients are responsible for ensuring that only they or their authorized designees utilize their accounts. Suspected incidents of unauthorized use of a client account should be reported immediately to our Abuse Investigations department at abuse@perfecthost.net for attention.

This site contains links to resources outside the Perfecthost web site. Perfecthost is not responsible for the content of those sites.
